Felony Classes


Class X

In Illinois, a Class X felony carries a sentence of 6 to 30 years in the Department of Corrections. Because Class X felonies are generally not eligible for probation, it's crucial to approach each case with the aim of getting the charges dismissed or reduced to a less severe offense.


Class 1

A Class 1 felony in Illinois is punishable by 4 to 15 years in the Department of Corrections and can carry a fine of up to $25,000. Common examples of Class 1 felonies include criminal sexual assault, drug delivery, and drug possession, particularly involving substances like heroin, cocaine, or methamphetamine.


Class 2

A Class 2 felony in Illinois is punishable by 3 to 7 years in the Department of Corrections and may include a fine of up to $25,000. Typical cases involving Class 2 felonies include drug possession, drug delivery, certain DUI offenses, and burglary.


Class 3

A Class 3 felony in Illinois carries a sentence of 2 to 5 years in the Department of Corrections and can include a fine of up to $25,000. Common cases involving Class 3 felonies include drug possession, drug delivery, aggravated battery, theft, and certain DUI offenses.


Class 4

A Class 4 felony is the least severe felony in Illinois, carrying a penalty of 1 to 3 years in the Department of Corrections and a fine of up to $25,000. Typical cases include driving with a revoked license, possession of a controlled substance, aggravated assault, certain DUI offenses, violation of an order of protection, and domestic battery.
